TEXT ORDER: In response to the petition for a writ of habeas corpus (DN 1 ), the Court directs the Respondents to show cause, no later than 3/30/26, why the writ should not be granted. See 28 U.S.C. § 2243. The Government should respond to the Petitioner's contention that the Court must grant the habeas petition based on a classwide declaratory judgment, Bautista v. Santacruz, --- F. Supp. 3d --- No. 5:25-cv-1873, 2025 WL 3713987 (C.D. Cal. Dec. 18, 2025). See also Ramirez v. Smith, No. 5:25-cv-186, 2026 WL 228778 (W.D. Ky. Jan. 28, 2026); Samayoa v. Smith, No. 5:25-cv-190, 2026 WL 483243 (W.D. Ky. Feb. 20, 2026). And the Government should address the effect of the Ninth Circuit's stay of that declaratory judgment outside the Central District of California. See Bautista v. U.S. Dep't of Homeland Security, --- F.4th ---, No. 26-1044 (9th Cir. Mar. 6, 2026); Petition at 1. The Court also directs the parties to file, no later than 3/31/26, a joint status report or separate letters advising the Court whether they seek a hearing or instead prefer that the Court set a briefing schedule and decide the petition on the papers. The Clerk of Court shall forward by certified mail, return receipt requested, one copy of the petition and this order on each Respondent who has not been designated by the United States Attorney's Office, as agreed to by the Attorney's Office and the Clerk in the 1/20/26 Memorandum of Understanding, to receive electronic notice and service.
