** TEXT ONLY ORDER ** Representing himself, Jaysen Saly has filed an emergency petition for a writ of habeas corpus under 28 U.S.C. § 2241 as legal guardian and next friend of his brother, Kaysone Saly. (Dkt. # 1 .) Jaysen seeks Kaysone's release from the Douglas County Jail, where he is reportedly confined by Immigration and Customs Enforcement. Jaysen explains that Kaysone has schizophrenia and has been declared legally incompetent. Jaysen has filed an emergency motion for a temporary restraining order and a motion for immediate, expedited review. (Dkts. ## 2 -3.) Unfortunately, the motions must be DENIED. Except under limited circumstances not present here, representative parties such as next friends may not conduct litigation pro se. Elustra v. Mineo, 595 F.3d 699, 704 (7th Cir. 2010); see also Parks v. Township of Portage, Cambria Cnty., 385 F. App'x 118, 121 (3rd Cir. 2010) (a non-attorney sibling may not represent other siblings pro se). As a rule, pleadings may be brought before the court only by parties or their attorney. See 28 U.S.C. § 1654 (providing that "parties may plead and conduct their own cases personally or by counsel"); Fed. R. Civ. P. 11(a) (requiring that every motion be signed by an attorney or a party proceeding pro se). Jaysen Saly is neither a party nor an attorney. Accordingly, this case will be dismissed unless within 21 days from the date of this order an attorney of record appears on behalf of Jaysen or the court is able to successfully recruit pro bono counsel Kaysone under 28 U.S.C. § 1915(e)(1). ** TEXT ONLY ORDER ** Petitioner Kaysone Saly, through his legal guardian Jaysen Saly and with the assistance of counsel, has filed an amended petition for a writ of habeas corpus under 28 U.S.C. § 2241 to challenge his detention by immigration officials pursuant to an order of removal, noting that he had been previously released on an order of supervision that was not properly revoked. (Dkt. # 11 .) Petitioner, who suffers from severe mental illness and was taken by ICE agents from a supervised mental health facility, seeks immediate release directly into his legal guardian's custody. (Id.) The court concludes that expedited consideration is appropriate. Because petitioner is proceeding in forma pauperis and is represented by counsel who agreed to take this case pro bono, the clerk's office is directed to serve the petition (dkt. # 11 ) and supporting declaration (dkt. # 12 ) on respondents, the local United States Attorney, and the United States Attorney General by certified mail, in accordance with Federal Rule of Civil Procedure 4(i).
