ORDER denying 2 Motion for TRO The Court is compelled to deny Petitioner's Motion for Temporary Restraining Order because it does not demonstrate reasonable likelihood of success on the merits. Specifically, its seeks an order enjoining Petitioner's transfer outside of the Western District of Pennsylvania. But it is well established that the Court lacks jurisdiction to do so. Under 8 USC 1231(g)(1), the place of an alien's detention is left to the discretion of the Attorney General of the United States. Courts will not disturb the exclusive discretion of the Attorney General as to where an alien detainee is housed. See Calla-Collado v. Attorney General of the U.S., 663 F.3d 680, 685 (3d Cir. 2011). As such, the Court must deny the Motion for Temporary Restraining Order. A case management order will issue forthwith as to the merits of the Petition for Habeas Corpus. Signed by Judge William S.
