TEXT ORDER: Before the Court is Petitioner's renewed Motion for Temporary Restraining Order ("TRO"), requesting the Court enjoin Respondents from removing or deporting Petitioner, or detaining Petitioner for purposes of removing him. (ECF No. 5) On March 17, 2026, the Court ordered Respondents to file an answer to Petitioner's petition for writ of habeas corpus and to his request for a preliminary injunction. (ECF No. 4.) The Court has considered the renewed TRO Motion and finds Petitioner cannot show a likelihood of success on the merits, as he has not shown the Court has jurisdiction to enjoin his detention or removal given his final order of removal and because his children, although applying for Special Immigration Juvenile Status ("SIJS"), do not have SIJS yet. (See ECF No. 3, at 5 ("the children have pending I-360 [] SIJS petitions with [United States Citizenship and Immigration Services]").) The Court does not now decide the issue of jurisdiction, rather has determined that briefing from the parties is necessary. As such, Petitioner renewed TRO Motion will be denied. However, the Court will update the briefing schedule. It is ORDERED that Petitioner's renewed Motion for TRO (ECF No. 5) is DENIED; it is further ORDERED that within seven (7) days of the date of the entry of this Order, Respondents shall electronically file a full and complete answer to said Petition, which responds to the factual and legal allegations of the Petition paragraph by paragraph; Respondents shall address all Petitioner's claims, specifically addressing (1) Petitioner's request for a preliminary injunction, and (2) the Court's jurisdiction to consider Petitioner's claims, including any jurisdiction under Castro v. United States Dep't of Homeland Sec., 835 F.3d 422 (3d Cir. 2016) and Osorio-Martinez v. Attorney General, 893 F.3d 153 (3d Cir. 2018); it is further ORDERED that Petitioner may file and serve a reply in support of the Petition and the PI Motion within three (3) days after the answer is filing; it is finally ORDERED that the remainder for the Court's March 17, 2026 Order to Answer remain in full effect.
