Gary Klausner: ORDER RE PETITIONER'S EX PARTE APPLICATION FOR TEMPORARY RESTRAINING ORDER 12 .On December 30, 2025, Jose Luis Llano filed a Writ of Habeas Corpus and on January 29, 2026 filed the present Application for Temporary Restraining Order against Merrick B. Garland, the Secretary of the Department of Homeland Security, the Director of Immigration and Customs Enforcement ("ICE"), and the Warden of the California City Correctional Center. (ECF Nos. 1, 12.) Petitioner is in ICE custody.Petitioner seeks the Court's order that he be released from custody or granted a bond hearing because Respondents are violating due process by allegedly keeping him in indefinite detention. It is not clear to the Court why Petitioner, who has been in custody for 105+ days, requires immediate action through the ex parte process to be released from custody.Petitioner fails to establish why his Ex Parte Application cannot be calendared in the usual manner. This case was filed on December 30, 2025 in the Central District of California (Doc. 1 ) and transferred to this Court on March 17, 2026 (Doc. 17 ), several weeks after a substantially identical petition in Case No. 1:26-cv-01399-JLT-SAB, was transferred to this Court. Though the cases bear different names (with Case No. 1:26-cv-01399-JLT-SAB bearing the name of the Petitioner, and this case bearing the name of Petitioner's next friend), the Petitions appear to be identical and concern the same immigration detainee. In addition, the same Counsel has appeared for Petitioner in both proceedings. Thus, within three business days of the date of this order, the Parties are directed to indicate if they object to this action being dismissed as duplicative.
