MINUTE ENTRY AND ORDER: On March 25, 2026, the Court held a hearing as to Petitioner's petition for a writ of habeas corpus 1 (the "Petition"). Michael Z. Goldman appeared on behalf of Petitioner. Kathleen Anne Mahoney appeared on behalf of Respondents. During the proceeding, the Court heard arguments by both Petitioner and Respondents. Consistent with their arguments, the Court finds that Petitioner's detention is governed by 8 U.S.C. § 1226. Accordingly, pursuant to § 1226, Petitioner was entitled to an individualized custody determination. As will be set forth more fully in a forthcoming memorandum of law, Petitioner did not receive one. And, in view of the considerations set forth in Mathews v. Eldridge, 424 U.S. 319 (1976), Respondents' failure to provide Petitioner with a second pre-detention process, notice, or opportunity to respond was in contravention of Petitioner's due process rights guaranteed under the United States Constitution. For these reasons, the Petition 1 is GRANTED in part. Specifically, the Court grants Count One of the Petition on the grounds that Petitioner was denied due process in violation of the Fifth Amendment of the United States Constitution. In addition, because Petitioner was ordered to be released on bond on November 13, 2025, following an Immigration Judge's determination that Petitioner does not present a danger to the community and is not a flight risk, the Court finds that a second bond hearing is unnecessary at this point. Indeed, during the hearing, Respondents conceded that the Board of Immigration Appeals' ("BIA") decision to grant Respondents' motion for a discretionary stay of the Immigration Judge's Order that Petitioner was to be released on bond, which allowed for Petitioner's re-detainment on December 8, 2026, resulted from the BIA considering erroneous information on an ex parte basis. Accordingly, Respondents are directed to immediately release Petitioner from ICE detention and file a letter confirming such. The Court reserves determination on Petitioner's remaining claims.
