** TEXT ONLY ORDER **Petitioner, a non-citizen currently detained in Immigration and Customs Enforcement (ICE) custody, contends that respondents are detaining him unlawfully. Petitioner admits that he is subject to a final removal order issued more than 20 years ago, but he says that the government is detaining him indefinitely, in violation of 8 U.S.C. § 1231 and the Due Process Clause of the Fifth Amendment. Respondents' response to the petition will be due 14 days after petitioner files his certificate of service. Petitioner's reply will be due seven days after that. Petitioner also asks the court to issue "emergency injunctive relief prohibiting ICE from removing him from the United States." Dkt. 1, 3. But the authority petitioner cites, § 1231 and Zadvydas v. Davis, 533 U.S. 678 (2001), are about limitations on the government's authority to detain a non-citizen indefinitely pending removal. See Zadvydas, 533 U.S. at 699 ("continued detention is no longer authorized by statute" if "removal is no longer reasonably foreseeable"). Petitioner cites no authority limiting the government's authority to remove a non-citizen subject to a final order of removal, regardless of how much time has passed since the removal order was issued. Signed by District Judge James D. Peterson on 3/18/2026. (lam),(ps) (Entered: 03/18/2026)
