** TEXT ONLY ORDER ** Petitioner seeks relief under 28 U.S.C. § 2241, contending that the federal government is detaining him unlawfully pending removal proceedings. Most of his petition and all of the "legal framework" section of his petition was devoted to an argument that his detention is unlawful under 8 U.S.C. § 1226(a). Dkt. 1, 42-69. In its response, the government argued that petitioner is being held under 8 U.S.C. § 1225(b), so any failure to comply with § 1226 is irrelevant. Petitioner does not meaningfully respond to the government's argument in his reply brief. Instead, he develops an argument for the first time explaining why he believes his detention violates the Due Process Clause. Dkt. 8 . Petitioner did include a contention in his petition that his detention violates the Due Process Clause, Dkt. 1, 70-71, 91, but there was no discussion of that issue. Before the court rules on the due process issue, the court will give the government until April 27, 2026, to file a supplemental brief addressing the argument that petitioner is entitled to release or a bond hearing under the Fifth Amendment. Petitioner may have until May 4 to respond.If the government does not respond by then, the court will decide the issue without the government's input. Signed by District Judge James D.
