Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Before the Court is Petitioner Vittini Arias Yunior Radhames’ petition for writ of habeas corpus. [ECF No. 1 ]. Respondents submit that the facts of this case are substantially similar to those of Duran Siguenza v. Moniz, No. 25-cv-11914, 2025 WL 2734704 (D. Mass. Sep. 25, 2025), such that “if this Court adheres to its prior reasoning, a similar result is likely in this case.” [ECF No. 13 at 2]. Accordingly, they “submit that the Court can decide this matter without further briefing or oral argument.” [Id. at 2]. In Duran Siguenza, the Court, pursuant to Zadvydas v. Davis, 533 U.S. 678 (2001), ordered the release of a habeas petitioner who was subject to a final order of removal, had been detained for more than six months, and was not significantly likely to be removed in the reasonably foreseeable future. Duran Siguenza, 2025 WL 2734704 at *3-4. As Respondents here recognize, the facts of this case are similar in all relevant respects. See [ECF No. 13 at 2]. Petitioner is subject to a final order of removal, [ECF No. 13 at 2], and has been detained for more than six months, [ECF No. 1 at 4], and Respondents have not proffered any plans for his removal in the reasonably foreseeable future, [id.]; [ECF No. 13 at 2].Accordingly, Petitioner’s petition, [ECF No. 1 ], is GRANTED. Respondents are ORDERED to release Petitioner subject to conditions of release to be determined contemporaneously with his release from custody.(CAM) (Entered: 04/07/2026)
