TEXT ORDER: The Court having reviewed the parties' filings in this matter (ECF Nos. 1, 5 ), and the Government having admitted that this matter is not meaningfully distinguishable from this Court's decision in Aguilar Ramos v. Soto, No. 25-15315, 2025 WL 3251447 (D.N.J. Nov. 21, 2025), and other decisions in this District interpreting 8 U.S.C. § 1225(b)(2), this Court holds that Petitioner is subject to detention only under 8 U.S.C. § 1226(a). Petitioner's habeas petition is therefore GRANTED to the extent that it is ORDERED that, in accordance with 8 U.S.C. § 1226(a), within seven (7) days of the date of entry of this Text Order, Respondents shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether he presents a flight risk or a danger to the community. The order enjoining the Government from transferring Petitioner out of New Jersey shall remain in effect until Petitioner's bond hearing is completed. The Government shall report the outcome of Petitioner's bond hearing within three (3) days of the immigration judge issuing a decision on the bond issue.
