MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 3/17/2026: The court has reviewed Petitioner's 1 Petition for Writ of Habeas Corpus and 2 Motion for Temporary Restraining Order. This court has previously addressed the legal issues raised by Count One of the Petition. See e.g., M.M. v. Bondi, No. 1:26-cv-00813-DC-AC, 2026 WL 604200 (E.D. Cal. Mar. 4, 2026); Nasar v. Warden, No. 2:26-cv-00433-DC-AC, 2026 WL 731160 (E.D. Cal. Mar. 16, 2026). The court is contemplating ruling directly on the 1 Petition, with the understanding that the court will also consider any arguments made and exhibits submitted in support of the Motion for Temporary Restraining Order. See Fed. R. Civ. P. 65(a)(2) ("Before or after beginning the hearing on a motion for a preliminary injunction, the court may advance the trial on the merits and consolidate it with the hearing."); see also 28 U.S.C. § 2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require."); A.R. v. Chestnut, No. 1:26-cv-00551-KES-SAB, 2026 WL 227112, at *1 (E.D. Cal. Jan. 28, 2026) (considering preliminary injunction and merits of habeas petition simultaneously). Respondents shall file an Opposition or Statement of Non-Opposition to the 2 Motion for Temporary Restraining Order by 12:00 PM on 3/20/2026. In their response, Respondents shall substantively address whether there are any factual or legal issues in this case that materially distinguish it from the prior orders listed above. Petitioner may file a Reply by 12:00 PM on 3/31/2026. Both parties should address whether they oppose the court ruling directly on the Petition, albeit as to Count One only, to the extent a ruling on that Count entitles Petitioner to the relief sought in the Petition. MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 3/20/2026: In Respondents' 6 Opposition to Petitioner's 2 Motion for a Temporary Restraining Order, Respondents continue to oppose issuance of a Temporary Restraining Order. However, Respondents do not identify any material distinction between this case and the court's previous decisions in M.M. v. Bondi, No. 1:26-cv-00813-DC-AC, 2026 WL 604200 (E.D. Cal. Mar. 4, 2026); Nasar v. Warden, No. 2:26-cv-00433-DC-AC, 2026 WL 731160 (E.D. Cal. Mar. 16, 2026). Accordingly, pursuant to the court's reasoning in M.M. and Nasar, Petitioner's 2 Motion for a Temporary Restraining Order is GRANTED IN PART, and the court ORDERS the following: (1) Respondent shall, within fourteen (14) days of issuance of this Order, provide Petitioner with a bond hearing before an immigration judge at which the Government shall bear the burden of justifying Petitioner's continued detention by clear and convincing evidence; and (2) Petitioner's request for immediate release is DENIED. Moreover, in light of Respondents' non-opposition to treating Petitioner's Motion for a Temporary Restraining Order as a Motion for Preliminary Injunction (see Doc. No. 6), and given that the standard for issuing a Temporary Restraining Order is "substantially identical" to the standard for issuing a Preliminary Injunction, Stuhlbarg Int'l Sales Co. v. John D. Brush & Co., 240 F.3d 832, 839 n.7 (9th Cir. 2001), the court hereby ISSUES a Preliminary Injunction on the same terms. This case is REFERRED to the assigned Magistrate Judge for further proceedings. MINUTE ORDER issued by Courtroom Deputy for District Judge Dena M. Coggins on 4/24/2026: In Petitioner's 10 Motion for a Temporary Restraining Order, Petitioner argues that the bond hearing provided to him pursuant to the Court's 8 Order was unconstitutionally deficient because Petitioner "was notified of the hearing on the same day it occurred, was forced to proceed unprepared, and was deprived of counsel because his attorney was never notified." (Doc. No. 10 at 1.) Thus, Petitioner contends, he "had no opportunity to prepare evidence, obtain supporting documents, or coordinate with counsel." (Id. at 2.) However, Respondent contends in his 12 Opposition that Petitioner was served with a hearing notice on 3/24/2026, ten days before the hearing. (Doc. No. 12 at 2.) Respondent attaches to his 12 Opposition the notice of hearing showing service on 3/24/2026. (Doc. No. 13 at 84.) Further, Respondent argues that Petitioner had notice that his hearing would be held within fourteen days of the court's 3/20/2026 Order, such that he had the opportunity to prepare for the hearing, which occurred exactly fourteen days after that order. (Doc. No. 12 at 2.) Thus, Respondent argues Petitioner should be required to exhaust his administrative remedies before seeking habeas relief. (Id. at 2-3.) Respondent's argument is availing. Respondent attaches evidence demonstrating that Petitioner was given ten days' notice of the hearing, and Petitioner had constructive notice of the hearing pursuant to this court's 8 Order. To the extent Petitioner disagrees with the outcome of that hearing, that argument is properly raised by appeal to the Board of Immigration Appeals. See Loba L.M. v. Andrews, No. 1:25-cv-00611-JLT-SAB, 2026 WL 710307, at *8 (E.D. Cal. Mar. 13, 2026) ("Complaints about the conclusion the [immigration judge] reached must be presented through the normal immigration appeal process."). Thus, Petitioner has not demonstrated a likelihood of success on his claim that the bond hearing violated this court's 8 order or his Constitutional right to Due Process, and his 10 Motion for a Temporary Restraining Order is DENIED.
