ORDER denying 3 Motion for TRO Petitioner Kromah is an alien from Liberia who entered the United States without authorization. He is subject to a January 12, 2026 order of removal to Uganda--a third country. He filed an appeal from the order of removal which remains pending. He filed a Petition for Writ of Habeas Corpus in this Court seeking an individualized bond hearing under 8 USC 1226. He also filed the instant Motion for Temporary Restraining Order. That Motion asks the Court both to mandate the requested bond hearing and to enjoin Petitioner's removal from the United States. The Court is compelled to deny both requests. First, a TRO is not warranted with respect to the individualized bond hearing. That is the basis of the pending Petition for Writ of Habeas Corpus. The Motion does not seek to preserve the status quo, but to grant the ultimate requested relief. As to the request to enjoin his removal, the Court lacks the jurisdiction to do so. Under 8 USC 1252(a)(5) and (b)(9), district courts lack jurisdiction to review most claims relating to removal because judicial review of a final order or removal is available only through a petition for review in one of the circuit courts of appeal.
