TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Jorge Valdetano Jacinto, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) According to the Petition, Petitioner is a citizen of Mexico who has resided in the United States since 2010 and has an approved Form I-130 immigrant petition filed by his United States citizen spouse, through which he is pursuing lawful immigration status. The Petition further alleges that on March 6, 2026, Petitioner appeared for a scheduled Form I-130 interview at the USCIS Newark Field Office in Newark, New Jersey, at which time he was taken into custody by Immigration and Customs Enforcement. (Id.) Petitioner contends that Respondents have erroneously concluded that he is subject to mandatory detention under 8 U.S.C. § 1225(b)(2)(A), relying on Matter of Yajure-Hurtado, 29 I&N Dec. 216 (BIA 2025), thereby denying him the opportunity to seek release on bond pursuant to 8 U.S.C. § 1226(a), and that his continued detention without the opportunity for an individualized bond determination violates due process. (See id.) Having reviewed the Petition and the record presently before it, the Court finds that immediate relief is warranted. Accordingly, it is hereby ORDERED that Petitioner shall be IMMEDIATELY RELEASED from Respondents' custody. It is further ORDERED that Petitioner shall be restored to the legal posture and status he occupied immediately prior to his detention on March 6, 2026. Respondents shall file proof of Petitioner's release on the docket within forty-eight (48) hours of the entry of this Order. A formal written opinion setting forth the Court's reasoning will follow.
