ENDORSED ORDER: Text of Order: Respondents agree that the petitioner is entitled to a bond hearing as a matter of due process if the court applies Judge Elliott's reasoning in Destino v. FCI Berlin, Warden, Civ. no. 25-cv-374-SE-AJ, 2025 WL 4010424 (D.N.H. Dec. 24, 2025). The court finds Destino persuasive and applies it. The petition (doc. no. 2) is therefore granted to the extent that respondents are ordered to provide the petitioner with a constitutionally adequate bond hearing before an IJ within 7 days. On or before March 24, 2026, the government shall file a status report notifying the court of the result of that bond hearing. The court declines to enjoin petitioner's transfer outside of New Hampshire at this time as the petitioner has not separately moved for that form of relief and there is no indication that petitioner is likely to be transferred out of New Hampshire in the near future. Respondents are required to file a notice of transfer in this court at least 72 hours before any planned transfer. See doc. no. 3. Should respondents file such a notice or should petitioner obtain evidence that he is likely to be transferred, petitioner may file a motion for a TRO or other expedited injunctive relief.
