PAPERLESS ORDER. Ruiz-Ojeda has filed an 3 Emergency Motion for Immediate Release or Expedited Review. Two things. First, our Local Rules require a party filing an emergency motion to certify that the motion "in fact presents a true emergency" and "requires an immediate ruling because the Court would not be able to provide meaningful relief . . . after the expiration of seven days." S.D. Fla. L.R. 7.1(d)(1). But Ruiz-Ojeda didn't certify that his motion was a true emergency and has therefore violated Local Rule 7.1(d). See generally Motion [ECF No. 3]. So, we'll STRIKE the emergency designation attached to the Motion. Second, Ruiz-Ojeda hasn't given us a reason to expedite these proceedings or grant his request for immediate release. For one thing, we're required by statute to order the Respondent to show cause "within three days" or, for good cause shown, no more than "twenty days[,]" 28 U.S.C. § 2243, which we'll do by separate order. For another, the most we could ever do for Ruiz-Ojeda is order his immigration judge to give him a bond hearing—not release him from ICE custody. See Oscar v. Ripe, 751 F. Supp. 3d 1324, 1332 (S.D. Fla. 2024) (Middlebrooks, J.) (denying the petitioner's "request for release from custody . . . because '[t]he consensus is that ordering a bond hearing is the appropriate remedy when the length of detention has become unreasonable'" (quoting J.N.C.G. v. Warden, 2020 WL 5046870, at *7, n.5 (M.D. Ga. Aug. 26, 2020))). And since Ruiz-Ojeda's 1 Petition isn't ripe yet, it's too soon to decide if a bond hearing is appropriate.
