MINUTE ORDER (1) Granting 1 Petition, and (2) Denying as Moot 5 Motion for Appointment of Counsel. "Respondents... do not oppose an order from this Court directing a bond hearing be held pursuant to 8 U.S.C. § 1226(a)." (See ECF No. 6 at 1.) Accordingly, the Court GRANTS the 1 Petition and ORDERS Respondents to provide Petitioner with an individualized bond hearing under 8 U.S.C. § 1226(a) within fourteen days. Respondents SHALL NOT deny Petitioner's bond on the basis that 8 U.S.C. § 1225(b)(2) requires mandatory detention. Because the Court has granted Petitioner's 1 Petition, the Court DENIES AS MOOT Petitioner's 5 Motion for Appointment of Counsel Pursuant to 18 U.S.C. § 3006A. Respondents SHALL SERVE Petitioner with a copy of this Minute Order. (All non-registered users served via U.S. Mail Service) (no document attached) (sxd) (Entered: 03/24/2026)

MINUTE ORDER Denying Without Prejudice Motion to Enforce Judgment. Presently before the Court is Petitioner Jhoan Rodriguez-Pinto's 8 Notice to the Court, which the Court construes as a Motion to Enforce Judgment. As ordered by this Court, (see ECF No. 7 ), Petitioner received a bond hearing on April 7 and 20, 2026, and now seeks review of the Immigration Judge's denial of bond. (See generally ECF No. 8 .) Because Petitioner has failed to exhaust his administrative remedies by appealing to the Board of Immigration Appeals and has not raised any basis for waiving exhaustion, the Court DENIES WITHOUT PREJUDICE the 8 Motion. See Leonardo v. Crawford, 646 F.3d 1157, 1161 (9th Cir. 2011) (remanding with the instruction to dismiss the petition without prejudice because the petitioner had not exhausted his administrative remedies or demonstrated grounds for excusing exhaustion).
