TEXT ORDER: The Court has received and reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner Pablino Ortega (ECF No. 1). Petitioner alleges that he has resided in the United States since entering without inspection in or about December 1995. Petitioner further alleges that he has been detained since March 1, 2026, and that the Newark Immigration Court has been unable to process a bond redetermination request because his custodial status has not been updated to reflect his detention. Petitioner contends that Respondents are treating him as subject to mandatory detention under 8 U.S.C. § 1225(b)(2) based on his alleged entry without inspection, relying in part on the Board of Immigration Appeals' decision in Matter of Yajure Hurtado, 29 I. & N. Dec. 216 (BIA 2025), thereby depriving him of the opportunity to seek release on bond under 8 U.S.C. § 1226(a). Therefore, Respondents shall SHOW CAUSE within seven (7) days of the entry of this Order why the Petition for a Writ of Habeas Corpus should not be granted. Petitioner may file a reply within three (3) days after service of Respondents' response. Respondents shall not transfer Petitioner outside of New Jersey during the pendency of these proceedings.
