Kronstadt, The Motion is GRANTED-IN-PART and DENIED-IN-PART. Respondents and their officers, agents, employees, attorneys, and persons acting on their behalf, in concert or in participation with them are ENJOINED from removing or deporting Petitioner.5 This Order will remain in place for 14 days. A hearing as to whether a preliminary injunction should issue is set for October 30, 2025, at 8:30 a.m., with the precise time to be determined when the final calendar for that day issues. Petitioner shall file his opening brief and related submissions no later than October 20, 2025. Respondents shall file their opposition no later than October 24, 2025. No reply brief will be accepted. If the parties agree to extend these deadlines, they shall submit a corresponding stipulation and proposed order. ORDER ACCEPTING FINDINGS, CONCLUSIONS AND RECOMMENDATIONS OF UNITED STATES MAGISTRATE JUDGE by Judge John A. Kronstadt for Report and Recommendation (Issued) 24 IT IS ORDERED that: (1) the Report and Recommendation of the Magistrate Judge is a ccepted and adopted; and (2) Judgment shall be entered: (a) declaring that ICE's previous detention of Petitioner violated 8 C.F.R. sections 241.13(i)(2)-(3) and the Due Process Clause of the Fifth Amendment to the United States Constitution; and (b) permanently enjoining Respondents and their officers, agents, employees, attorneys and persons acting on their behalf, in concert or in participation with them, from (i) re-detaining Petitioner without notice and a predetention hearing befo re a neutral immigration judge at which it is determined that detention is appropriate and warranted under the applicable law and regulations either because Petitioner has violated a term of his release or because his deportation to Cambodia is immin ent and the necessary documents from the Republic of Cambodia have issued and are in the possession of ICE; and (ii) removing Petitioner to any country other than Cambodia without appropriate notice and an opportunity to be heard in accordance with the applicable ICE regulations.
