TEXT ORDER: This matter comes before the Court upon Petitioner Pedro Clemente Alvarado Camey's Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241, D.E. 1 ("Petition") and Motion for Temporary Restraining Order, D.E. 2 ("TRO Motion"). Petitioner challenges his detention by immigration authorities as unlawful and seeks immediate release. In accordance with Rule 4 of the Rules Governing 2254 Cases, applicable to § 2241 cases through Rule 1(b), scope of the Rules, this Court has screened the Petition for dismissal and determined dismissal without an answer is not warranted. Respondents shall file an expedited answer to the Petition within 7 days. In that Answer, Respondents shall inform the Court whether they stipulate that Petitioner has no criminal record. Pursuant to the All Writs Act, 28 U.S.C. § 1651, Petitioner shall not be transferred from New Jersey pending this habeas proceeding. The TRO Motion, D.E. 2, is DISMISSED as MOOT because the Court has enjoined Petitioner's transfer and expedited resolution of the Petition. In addition, the Court kindly requests that Petitioner's future filings comply with this District's Local Rules, which require all PDF filings to be text searchable. TEXT ORDER: This matter comes before the Court upon Petitioner Pedro Clemente Alvarado Camey's Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, in which he alleges that he is unlawfully detained under 8 U.S.C. § 1225(b)(2). D.E. 1 ("Petition"). Respondents filed an answer in opposition to habeas relief. D.E. 6 ("Answer") Respondents, however, stipulate that the Petition raises materially similar factual allegations, and that Respondents rely on the same statutory interpretation rejected by this Court in Lomeu v. Soto, No. 25-16589, 2025 WL 2981296 (D.N.J. Oct. 23, 2025) (interpreting § 1225(b)(2)), and many other decisions in this District. Answer at 1 & n.1 (collecting cases). Respondents also submit that Petitioner has a criminal record. D.E. 6-1, Ex. A ("Form I-213") at 2. As in Lomeu, the Court holds that Petitioner is subject to discretionary detention under § 1226(a), which entitles him to a bond hearing pursuant to 8 C.F.R. 236.1(d)(1). Accordingly, the Petition is GRANTED and Respondents shall provide Petitioner with a bond hearing pursuant to 8 C.F.R. 236.1(d)(1) within 7 days of this Order. Within 3 days of the bond hearing, Respondents shall file a status report advising the Court of the outcome of the bond hearing. So Ordered by Judge Evelyn Padin on 3/19/2026.
