PAPERLESS ORDER. THIS CAUSE comes before the Court upon sua sponte review of the record. On March 16, 2026, United States Immigration and Customs Enforcement issued a Notice of Revocation of Release to Petitioner stating that his release on the Order of Supervision dated April 27, 2015 has been revoked because "[c]ircumstances have changed such that there is a significant likelihood of removal in the reasonably foreseeable future." ECF No. [7-2] at 1. Respondents are ORDERED to file a Notice by March 20, 2026 advising the Court of Petitioner's intended removal date and the country to which Petitioner is to be removed, or any other basis for their claim that Petitioner will be removed in the reasonably foreseeable future. PAPERLESS ORDER. THIS CAUSE comes before the Court on Respondents' Sur-Reply. ECF No. 12 . In his Reply, Petitioner sets forth the reasons why Respondents allegedly failed to properly revoke his Order of Supervision. ECF No. 10 . Petitioner could not raise this argument in the Petition because the revocation took place after the Petition was filed. Respondents' Sur-Reply does not address Petitioner's claim that the revocation of his Order of Supervision violates due process. Id. at 3-5. The Sur-Reply also does not address Petitioner's claim that his detention is unconstitutional because the revocation of his Order of Supervision, which took place on the same day that Respondents filed their Response to the Petition, occurred three months after Petitioner was taken into ICE custody. Id. at 5. For these reasons, Respondents are ORDERED to file an amended sur-reply by April 24, 2026 which actually and meaningfully addresses the arguments that Petitioner raises in his Reply regarding the revocation of his Order of Supervision. If Respondents do not do so, the Court will assume that they do not contest Petitioner's arguments. Signed by Judge Jacqueline Becerra on 4/21/2026. (nsy) (Entered: 04/21/2026)
