MINUTE ORDER: Before the Court is Petitioner's Petition for Writ of Habeas Corpus, ECF No. 1, and Motion for a Temporary Restraining Order and Preliminary Injunction, ECF No. 3 . In the Petition, Petitioner requests that the Court "[i]ssue a writ of habeas corpus requiring that Respondents release Mr. Artola Arauz or provide Mr. Artola Arauz with a bond hearing pursuant to 8 U.S.C. § 1226(a) within seven days [.]" ECF No. 1 at 25. Plaintiff's motion seeks similar relief, requesting that the Court "grant a temporary restraining order requiring either Mr. Artola Arauz's release, or [order] that Respondents provide a bond hearing within 7 days." ECF No. 3 at 18. Having reviewed the Petition and Motion, the Court ORDERS Petitioner to, no later than October 20, 2025, (1) serve Respondents with a copy of the Petition, Motion, and accompanying papers, along with a copy of this Order, by e-mail and by overnight mail, and (2) promptly file proof of such service on the docket. Counsel for Respondents shall promptly enter notices of appearance. Within seven calendar days of service, Respondents are ORDERED TO RESPOND to the Motion and Petition and are ORDERED TO SHOW CAUSE as to why the Petition should not be granted. See, e.g., Yassine v. Collins, No. 1:25-cv-00786-ADA-SH, 2025 WL 1954064, at *1 (W.D. Tex. July 7, 2025) (explaining that while § 2243 refers to a three day deadline, this requirement is "subordinate to the district court's authority to set deadlines" itself, and granting respondents a fourteen day deadline to respond in order to "give [r]espondents adequate time to brief the issues" (quotations omitted)). Petitioner shall file a reply within five calendar days after Respondents response is filed. Pursuant to the All Writs Act, 28 U.S.C. § 1651(a), and in order to preserve the Court's jurisdiction, Respondents SHALL NOT REMOVE Petitioner from the District of Colorado or the United States unless or until this Court or the Court of Appeals for the Tenth Circuit vacates this Order. MINUTE ORDER: Before the Court is Petitioner's Petition for Writ of Habeas Corpus, ECF No. 1, and Motion for a Temporary Restraining Order and Preliminary Injunction, ECF No. 3 . In a sworn declaration submitted in connection with his motion, Petitioner represents that he has an underlying heart condition that requires specialized treatment and care from a cardiologist. ECF No. [3-1]. Additionally, a sworn statement from a physician submitted in support of the motion states that the Petitioner has "severe heart failure and a high likelihood of significant morbidity and/or mortality in the next year, even with optimal medical management." ECF No. [3-2] at 4. In light of the foregoing, as well as Respondents' decision to previously permit Petitioner to travel to a hospital for medical treatment despite his detainment, ECF No. [3-1] at 3, and in conjunction with the Court's previous Order to Show Cause, ECF No. 6, Respondents are further ORDERED TO SHOW CAUSE as to why the Petitioner should not be ordered temporarily released from detention, while remaining in custody, in order to seek appropriate medical care for his serious health concerns.
