ORDER. Petitioner Jose Raul Perez Hernandez, a self-represented immigrant detainee, filed two motions to substitute the respondent. Dkt. Nos. 13, 17 . He asserts that he was transferred from the Bluebonnet Detention Center to the Eden Detention Center, and he asks the Court to modify the caption to reflect the custodial change. The Court denies the motion as unnecessary. Jurisdiction attaches on the initial filing of a petition and is not destroyed by the transfer of a petitioner and accompanying custodial change. No. 18 . The Court denied Petitioner's first motion on March 12, 2026 after finding that Petitioner improperly requested the ultimate relief sought in his pending habeas petition. Dkt. No. 5 . ORDER. The Court has reviewed Petitioner's pleadings and Respondent's response with the attached records. Based upon the facts and the law set forth in Respondent's response and supported by the relevant records, the Court finds that Petitioner is not entitled to federal habeas relief. The Court has consistently found, in cases indistinguishable from this one, that applicants for admission like Petitioner are properly detained without bond under Section 1225(b)(2)(A), and that the Fifth Amendment does not require release under these circumstances.
