District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. This electronic order memorializes orders issued orally by the Court on the record during the hearing today. As stated, the Court has ORDERED that the respondents shall return the petitioner to Massachusetts tomorrow, March 12, 2026. The respondents, with the petitioner, shall depart New York by 9:00 AM on March 12. Upon her arrival to Massachusetts, the petitioner shall be released to the custody of her aunt pending further proceedings in Probate Court concerning guardianship. The aunt shall show a driver’s license or other state-issued identification at the time she takes custody of the petitioner. The release to the aunt shall occur at a location arranged in advance by counsel for the parties. This ruling is subject to the petitioner’s aunt submitting to the Court, before the petitioner’s release, an affidavit stating the following: 1) her relationship to the petitioner; 2) that she is a United States citizen; 3) that she intends to petition a Massachusetts Probate Court for legal guardianship of the petitioner; and 4) that she is willing and able to allow the petitioner to live with her, and can provide safe and suitable care for the petitioner. District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. On March 11, 2026, after a status conference with the parties at which the Court ordered the respondents to return the petitioner (a minor) to Massachusetts, the Court issued an Electronic Order requiring the respondents to “file with the Court... copies of all records documenting the respondents’ encounter with the petitioner on March 10, 2026, and their subsequent arrest, detention, and transfers of the petitioner.” Doc. No. 13 (emphasis added). These records were to be filed by March 20, 2026. Id. The respondents made a timely submission, but it does not fully comply with the Court’s order. The few reports the respondents have submitted expressly reference (at least) the following additional documents: a Form I-200 Warrant of Arrest for the petitioner; a Form I-286 Custody Determination for the petitioner; and a Notice to Appear initiating removal proceedings against the petitioner. They also strongly suggest the existence of additional documents authored by ORR regarding that agency’s encounter with and transfer of the petitioner. All of these documents are within the scope of the Court’s order to the respondents, but none were included in the submission. The respondents did not object to the scope of the order, explain the failure to include the additional responsive documents, or seek more time to comply. Accordingly, by Friday, March 27, 2026, the respondents shall file with the Court the missing documents described herein, as well as any other documents in their possession, custody, or control that are responsive to the Court’s March 11 order but were omitted from the respondents’ first submission.(FGD) (Entered: 03/23/2026)
