ORDER and FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Chi Soo Kim on 04/03/2026 DENYING Petitioner's 2 Motion to Appoint Counsel. It is RECOMMENDED that the 1 Petition for Writ of Habeas Corpus be granted, Respondents' 7 Motion to Dismiss be denied, that Respondents be ordered to immediately release Petitioner Boss Peterson Saint Louis, and be ordered to provide Petitioner with a copy of the release order at or near the time of release. It is RECOMMENDED that if Resp ondents have custody of Petitioner's documents (e.g., identification, passport, work permit, Social Security card, etc.), Respondents shall return those to Petitioner at the time of release, that Respondents be enjoined and restrained from re-de taining Petitioner unless the government demonstrates, by clear and convincing evidence at a pre-deprivation bond hearing before a neutral decisionmaker, that Petitioner is a flight risk or danger to the community such that his physical custody is le gally justified. This injunction does not address other circumstances where detention authority is established under a different authority than what is presented in this case. (e.g., 8 U.S.C. § 1226(c) or 8 U.S.C. § 1231). Given Petitioner& #039;s pro se status, it is RECOMMENDED that Respondents be directed to file, within 7 days of the adoption of these findings and recommendations, a status report addressing Petitioner's status and that the Clerk be directed to enter judgment in favor or Petitioner and close this case.
