ENDORSED ORDER granting the 2 Emergency MOTION for Temporary Restraining Order. Respondents and those in privity with them are hereby TEMPORARILY RESTRAINED AND ENJOINED from moving Petitioner Kenia Suyapa Claros Portillo out of the Middle District of Florida until further order of the Court. See Garcia v. Quinones et al., No. 6:26-cv-181-GAP-DCI, Doc. 6 (M.D. Fla. Jan. 26, 2026). With respect to the 1 Petition for Writ of Habeas Corpus, the Court finds that: (1) Petitioner Kenia Suyapa Claros Portillo is in custody under or by color of the authority of the United States, i.e., Immigration and Customs Enforcement ("ICE"); and (2) as noted in the Court's Temporary Restraining Order in Garcia, Portillo's detention is likely unlawful. Therefore, it is ORDERED that the United States Government by its Agent ICE shall SHOW CAUSE in writing by noon on Wednesday, March 11, 2026, why the Writ should not be granted. Furthermore, TAKE NOTICE that the Court will consider this matter at a hearing scheduled at 9:00 AM on Friday, March 13, 2026, before the undersigned. ORDER granting Petitioner Kenia Suyapa Claros Portillo's 1 Petition for Writ of Habeas Corpus and 5 Emergency Motion for Immediate Release or Expedited Adjudication. The Hearing scheduled for Friday, March 13, 2026 is hereby CANCELLED. Respondents shall IMMEDIATELY RELEASE or facilitate the release of the Petitioner from custody and IMMEDIATELY notify her counsel where and when she may be picked up. Respondents shall IMMEDIATELY return all of Petitioner's documentation and any other personal property. Respondents and all other persons or entities acting in active concert or participation with them are RESTRAINED AND ENJOINED from re-arresting or detaining Petitioner UNTIL FURTHER ORDER OF THE COURT. No security bond is required. Petitioner is DIRECTED to notify her counsel should her place of residence change while her immigration proceedings are ongoing.
