ORDER VACATING 15 Judgment Order pursuant to Rule 58 entered in favor of Respondents and against Petitioner. On 3/24/2026, the Court issued an 14 order dismissing the 1 Petition as moot. The Court also issued a 15 Judgment Order pursuant to Rule 58 entering judgment in favor of Respondents. However, because the Court dismissed the 1 Petition as moot and did not reach the merits, the dismissal of the 1 Petition was without prejudice. See Korvettes, Inc. v. Brous, 617 F.2d 1021, 1024 (3d Cir.1980) ("A dismissal for lack of jurisdiction is plainly not a determination of the merits of a claim. Ordinarily, such a dismissal is 'without prejudice.' ").
