ENDORSED ORDER. Text of Order: Petitioner asserts that she entered the United States without inspection in 2022 and lived in the community until she was arrested by ICE agents on March 4, 2026. She asserts a violation of her Fifth Amendment Right to Due Process and seeks immediate release or a bond hearing before an IJ. Respondents do not contest petitioner's factual allegations, but contend that she has not met her burden to show that she is entitled to relief. The court disagrees. Petitioner has sufficiently shown that she is similarly situated to the petitioner granted similar relief on grounds of procedural due process in Destino v. FCI Berlin Warden, 2025 DNH 149, 2025 WL 4010424 (D.N.H. Dec. 24, 2025). The court finds Destino persuasive and applies it. The petition (doc. no. 1) is therefore granted. Respondents are ordered to provide the petitioner with a constitutionally adequate bond hearing before an IJ within 7 days. On or before March 21, the government shall file a status report notifying the court of the result of that bond hearing. So Ordered by Judge Landya B. McCafferty.(vln)
