District Judge Julia E. Kobick: ELECTRONIC ORDER entered. Petitioner Steven Darma, who is representing himself in this case, has filed a Petition for a Writ of Habeas Corpus under 28 U.S.C. § 2241. ECF 1 . The only information in the pleading is Darma’s place of confinement (Plymouth County Correctional Facility) and his Alien Registration Number.Habeas relief under 28 U.S.C. § 2241 is available if a person is “in custody in violation of the Constitution or laws or treaties of the United States.” 28 U.S.C. § 2241(c)(3). “[T]he essence of habeas corpus is an attack by a person in custody upon the legality of that custody, and . . . the traditional function of the writ is to secure release from illegal custody.” Preiser v. Rodriguez, 411 U.S. 475, 484 (1973). Darma’s petition does not contain enough information to allow this Court to take any action. Darma does not identify when he was taken into custody, the reason he was taken into custody, why he claims that his custody is unlawful, and what relief he seeks.If Darma wishes to proceed with this action, he must, within 21 days, file an amended petition that provides this information. Failure to do so will result in dismissal of this action without prejudice. Darma is not required to use a form to prepare an amended petition (though he may use a form if he prefers). If Darma elects not to use a form, he may submit a document with the title “Amended Petition” and the docket number of this case (26-cv-11162-JEK) at the top, followed by the relevant information. Darma must sign the amended petition. There is a $5.00 fee to file a petition for a writ of habeas corpus. If Darma would like to ask the Court to waive the fee, he may submit a completed Application to Proceed in District Court Without Prepaying Fees or Costs. The Clerk shall provide this form to Darma.
