MINUTE ORDER (Text Entry Only) The Court has reviewed the Petition filed under 28 U.S.C. § 2241 (Doc. 1) and the related request for emergency injunctive relief (Doc. 3). Petitioner asserts that he has been detained "more than 100 days" (Doc. 1 at 2) and has had a bond hearing, which was denied for reasons that are not explained (Doc. 1 at 11). Petitioner does not explain his delay in seeking his request for a temporary restraining order or why despite this delay, the Court should treat the situation as an emergency. Thus, the TRO request is untimely, and it is DENIED. Local Rule 231(b). The Court refers the matter to the assigned magistrate judge for a determination on the merits. The Court sets the following briefing schedule, which may be modified by the magistrate judge as needed. Respondents SHALL file their responsive pleading within 21 days. Petitioner may file a traverse no later than 7 days after the respondents file their brief.In the meantime, unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Given the circumstances, the Court finds that this order is warranted to maintain the status quo pending the hearing and any subsequent order and finds that Petitioner has satisfied the factors governing the issuance of such relief signed by District Judge Jennifer L. MINUTE ORDER (Text Only Entry) Petitioner has filed a motion for temporary restraining order (Doc.15) --the second in ten days. The first set forth various reasons for his immediate release including that he has not received sufficient medical care related to shoulder pain resulting from a tendon injury, which he had been planning to have repaired surgically before his detention (Doc. 1 at 11). He also mentioned that he had "hypertension and high blood pressure," which the Court understands is the same thing. (Id. at 7) The Court denied the first TRO as untimely because he had been in custody for "more than 100 days" (Doc. 1 at 2) and did not explain his delay in seeking an emergency motion or why an emergency existed. The Court cited Local Rule 231(b). (Doc. 6) In his current TRO, he reports that he received medical attention at which it was discovered he had a very high blood pressure reading. (Doc. 15 at 4) Medical staff adjusted his medication--which, apparently, had been provided to him previously--but Petitioner disagrees with this course of treatment. In any event, the Court ORDERS: Within 5 days, Respondents SHALL file a report detailing the medical care Petitioner is receiving related to his hypertension and explaining why this level of care is sufficient. MINUTE ORDER (Text Entry Only) The Court held in abeyance Petitioner's second motion for temporary restraining order (Doc. 15 ) and called for Respondents to file a report providing details about Petitioner's medical care. (See Doc. 16 .) Respondents subsequently provided a declaration from Dr. Rae Patterson, a physician who, though practicing at a different facility, has reviewed Petitioner's medical records and opines that Petitioner is receiving "clinically appropriate treatment, medication, and monitoring for his medical conditions, including hypertension." (Doc. 18 -1 at para. 10.) In the first amended petition, Petitioner expresses his own subjective disagreement with Dr. Patterson's conclusions, but provides no specific medical facts that suggest the habeas relief requested (immediate release) is warranted based upon his medical situation. Thus, the TRO is DENIED. The assigned magistrate judge has already set a deadline for Respondents to respond to the amended petition. (Doc. 13 .)
