District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The MOTION for TRO is ALLOWED IN PART as outlined below. Today, Sunday October 12, 2025, Petitioners filed a habeas petition. The petition, TRO motion and exhibits disclose the following information. Earlier this year, an Immigration Judge denied petitioners asylum, withholding of removal and relief from removal under the Convention Against Torture, although finding them credible. On September 15, 2025, the Board of Immigration Appeal dismissed the appeal of Petitioners summarily including denial of a stay of removal for the wife on grounds that she had not filed for various forms of relief. Petitioner had counsel before the immigration judge. The petition alleges that a consulting firm claiming to be lawyers represented Petitioners on appeal to the BIA resulting in the failure to file timely documents thereby causing the summary denial. Different counsel now represents petitioner as she has for about seven days. Counsel represents that at least as to the wife a T Visa and renewed asylum applications are pending as well as possibly an effort to reopen in front of the BIA or appeal to the Circuit. Petitioner is on an ankle bracelet and is supposed to voluntarily deport today per directions from ICE. The Petition alleges counsel and petitioner have been attempting today to reach ICE, to arrange a stay. Petitioner alleges violation of her due process rights further undermined by ineffective assistance of purported counsel. Under the unusual circumstances presented here including that perhaps but for the misrepresentation of an allegedly sham consulting firm, the appeal of petitioners to the BIA would be pending for consideration on the merits, the Court hereby enters the following TRO ORDERS: (1) the removal of Petitioners from the United States is STAYED; (2) Petitioners shall neither leave the District of MAssachusetts nor shall they be moved out of the District of Massachusetts; (3) the consulting firm listed in the TRO Motion shall show cause no later than two business days after notice of this Order why the consulting firm should not be required to produce a copy of its entire file on Petitioners to counsel for Petitioners; (4) Petitioners shall show cause no later than Friday October 17, 2025, why this Court has habeas jurisdiction with a response from the government by October 21, 2025; (5) the Clerk shall provide a copy of this Order to the duty AUSA and the USAO; (6) Counsel for Petitioner shall work with the duty AUSA to notify ICE of this Order; (7) Counsel for Petitioner shall notify the consulting firm of this Order. The Court makes this Order as the duty Judge. Upon the assignment of this matter to a randomly assigned presiding judge, nothing prevents that Judge from modifying or vacating these orders. Absent further Order of the Court, the stay of removal expires on its own on October 22, 2025. (CM) (Entered: 10/12/2025)
