ORDER: To preserve the Court's jurisdiction pending a ruling in this matter, Petitioner shall not be removed from the United States unless and until the Court orders otherwise. See, e.g., Loc. 1814, Int'l Longshoremen's Ass'n, AFL-CIO v. New York Shipping Ass'n, Inc., 965 F.2d 1224, 1237 (2d Cir. 1992) ("Once the district court acquires jurisdiction over the subject matter of, and the parties to, the litigation, the All Writs Act [28 U.S.C. § 1651] authorizes a federal court to protect that jurisdiction." (quotations omitted)); Garcia-Izquierdo v. Gartner, No. 04-CV-7377, 2004 WL 2093515, at *2 (S.D.N.Y. Sep. 17, 2004) (observing that, under the All Writs Act, 28 U.S.C. § 1651, a district court "may order that a petitioner's deportation be stayed when a stay is necessary to preserve the Court's jurisdiction of the case"); Khalil v. Joyce, 771 F. Supp. 3d 268, 274 (S.D.N.Y. 2025) (barring the government from removing petitioner from the United States until the Court could address his claim); cf. Michael v. I.N.S., 48 F.3d 657, 661-62 (2d Cir. 1995) (holding that the All Writs Act provides a federal court of appeals reviewing a final removal order with a basis to stay removal). And in addition, in light of Petitioner's interests in participating in further proceedings before this Court and in maintaining adequate access to legal counsel through these proceedings, it is further ORDERED that Petitioner shall not be transferred except to a facility within this District, the Eastern District of New York, or the Southern District of New York, absent further order of this Court. See Ozturk v. Trump, 779 F. Supp. 3d 462, 496 (D. Vt. 2025) (ordering petitioner's transfer from Louisiana to Vermont due, in part, to her pending habeas petition), stay and mandamus denied, Ozturk v. Hyde, 136 F.4th 382, 403 (2d Cir. 2025). Respondents must file a response to the writ—including any legal or factual arguments why the writ should not be granted—by March 4, 2026 at 5:00 P.M. Respondents must also inform the Court of Petitioner's location, and must include information about any other locations where Petitioner has been held and the dates of any transfers since her initial detention on March 1, 2026 by the same deadline. ORDER: The Clerk is directed to transfer this case to the Southern District of New York in light of the fact that Petitioner was being detained in that district at the time immediately prior to and on the date the petition was filed. See Trump v. J.G.G., 604 U.S. 670, 672 (2025) ("The detainees are confined in Texas, so venue is improper in the District of Columbia."); 28 U.S.C. § 1404(a). The Clerk is directed to effectuate this transfer immediately and the waiting period under Local Civil Rule 83.1 is waived. The Order prohibiting Petitioner's removal or transfer outside of EDNY or SDNY remains in effect unless and until the transferee court orders otherwise. See, e.g., Saamishvili v. Flanagan, No. 25-CV-9181, 2025 WL 3090134, at *1 (S.D.N.Y. Nov. 5, 2025) (transferring a petition to the Eastern District of New York and enjoining the government from removing petitioner from that district to ensure that petitioner has an opportunity to have their petition considered) (citing Khalil v. ORDER TO ANSWER, 28 U.S.C. § 2241: Petitioner has filed a Petition for the writ of habeas corpus under 28 U.S.C. § 2241. The Court, having examined the Petition, hereby ORDERS that no later than Friday, March 6, 2026, at noon, Respondents shall file a letter with the following information: a. whether Petitioner was located in the Southern District of New York at the time that the Petition was filed and, if not, what District Petitioner was in at the time of filing and whether the Petition should be immediately transferred to that District, see, e.g., ztürk v. Hyde, 136 F.4th 382, 391-92 (2d Cir. 2025); Khalil v. Joyce, 771 F. Supp. 3d 268 (S.D.N.Y. 2025); b. Petitioner's A-number and current place of detention; c. the statutory provision(s) under which Respondents assert the authority to detain Petitioner; d. whether there is any basis to distinguish this case from Quispe-Sulcaray v. Noem et al., 25-CV-09908-VEC, or Pastuna Pastuna v. Francis et al., 26-CV-00398-VEC. If not, whether Respondents would consent to issuance of the writ, subject to preservation of Respondents' arguments for appeal. If there is a basis to distinguish, whether Respondents waive the right to submit an answer and consent to issuance of the writ, subject to preservation of Respondents' arguments for appeal; e. a copy of any final order of removal; and f. any information regarding the procedural posture of any pending Department of Homeland Security or Executive Office for Immigration Review proceedings. The parties shall appear for a conference with the Court in Courtroom 20C of the Daniel Patrick Moynihan Courthouse, 500 Pearl Street, New York, New York, 10007 on Friday, March 6, 2026, at 3:00 p.m. To preserve the Court's jurisdiction pending a ruling on the Petition, Petitioner shall not be removed from the United States absent further order of this Court. See, e.g., Khalil v. Joyce, No. 25-CV-1935 (JMF), 2025 WL 750599, at *1 (S.D.N.Y. Mar. 10, 2025) (citing cases); see also, e.g., Du v. United States Dep't of Homeland Sec., No. 25-CV-0644 (OAW), 2025 WL 1317944, at *1 (D. Conn. Apr. 24, 2025) ([A] a federal court may temporarily enjoin immigration authorities from deporting individuals if it preserves the court's jurisdiction over a case or cases.). Moreover, in light of Petitioner's interests in participating in further proceedings before this Court and to facilitate resolution of the Petition, Respondents shall not transfer Petitioner except to a facility within this District, the Eastern District of New York, or the District of New Jersey absent further order of this Court. See, e.g., Perez y Perez v. Noem, No. 25-CV-4828 (DEH), 2025 WL 1908284, at *2-3 (S.D.N.Y. June 13, 2025) (enjoining a habeas petitioner's transfer pending adjudication of his petition); see also, e.g., Arostegui-Maldonado v. Baltazar, No. 25-CV-2205 (WJM) (STV), 2025 WL 2280357, at *14-16 (D. Colo. Aug. 8, 2025) (same); Oliveros v. Kaiser, No. 25-CV-7117 (BLF), 2025 WL 2677125, at *8-9, *11 (N.D. Cal.
