Peterson on 4/17/2026: On 4/10/2026, I issued findings and recommendations, recommending that the petition for writ of habeas corpus, ECF No. 1, be granted. (ECF No. 10 .) On 4/14/2026, respondents filed objections, wherein they argue that petitioner "did not dispute the government's assertion that he is subject to mandatory detention under" 8 U.S.C. § 1225(b), and that, "until the findings were issued, Respondents lacked notice that Petitioner was contesting the claim that he was detained under § 1225(b)." (ECF No. 11 .) In light of respondents' objections, the findings and recommendations at ECF No. 10 are hereby VACATED. By close of business on 4/21/2026, petitioner is ORDERED to file a supplemental brief that includes any relevant factual allegations and addresses whether petitioner is subject to mandatory detention under § 1225(b).
