TEXT ORDER re 16 Motion for Reconsideration filed by BRIAN MCSHANE, LEONARD ODDO, KRISTI NOEM, and PAM BONDI. The government asks the Court to reconsider its July 11, 2025 Order granting Deonarine a bond hearing. ECF No. 15. The government argues there is new evidence that was not available when the Court issued its Order. First, on July 2, 2025, the Republic of Suriname issued travel documents authorizing Deonarine's removal to his native country. ECF No. 16-1. And second, Deonarine is now subject to a final order of removal and, as a result, he is now subject to mandatory detention under 8 U.S.C. § 1231(a). The government has presented no documentary evidence that Deonarine is in fact subject to a final order of removal. The present record before the Court reflects an Order of Removal was issued on April 15, 2025, and an appeal was due by May 15, 2025. The record also shows Deonarine reserved his right to appeal. But the record is void of any documentary evidence demonstrating that Deonarine did not appeal the decision of the immigration judge or if an appeal was unsuccessful. In essence, the Court cannot determine from the record before it whether Deonarie is in fact now subject to a "final" order of removal. The government shall provide the Court by August 5, 2025, documentation supporting its position that Deonarine is now subject to a "final" order of removal. In light of this new information, the Order at ECF No. 15 is STAYED. The motion for reconsideration will remain under consideration pending receipt by the Court of the requested information by the government. Signed by Magistrate Judge Christopher B.
