TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Carlos E. Neres Pereira, who is presently detained at the Delaney Hall Detention Facility in New Jersey. (ECF No. 1.) Petitioner alleges that his current immigration detention is unlawful. According to the Petition, Petitioner entered the United States in May 2022 and was subsequently paroled into the country after expressing a fear of return. In January 2024, U.S. Citizenship and Immigration Services approved Petitioner's application for Special Immigrant Juvenile Status and granted him deferred action while he awaits visa availability to pursue adjustment of status. Petitioner contends that, following a February 2026 credible fear interview and a negative credible fear determination, he was taken into ICE custody without adequate process and is now being subjected to mandatory detention. (See id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, no later than Thursday, March 12, 2026, why the Petition for habeas corpus relief should not be granted. Petitioner may file a reply brief in support of the Petition within three (3) business days after the filing of Respondents' answer. Petitioner shall serve a copy of this Order and the habeas petition upon Respondents within two (2) business days of the entry of this Order, and promptly file proof of service on the docket.
