(Text-Only) TEXT ORDER.Respondents' response (Doc. No. 6) and supplemental filing (Doc. No. 10) assert that the immigration judge entered a removal order against Petitioner on February 2, 2026; that the Board of Immigration Appeals rejected Petitioner's attempted appeals on March 5 and March 10, 2026; and that the time to file a timely appeal expired on March 4, 2026. Respondents therefore contend that the removal order is administratively final and that Petitioners detention is governed by 8 U.S.C. § 1231.Petitioner asserts that he filed a corrected Notice of Appeal on March 6, 2026. (Doc. Nos. 11, 12.) Petitioner's submission, however, does not address the second Notice of Rejected Filing dated March 10, 2026, included in Respondents' supplemental response. (Doc. No. 10-4.) Because the finality of the removal order bears directly on the statutory authority governing Petitioner's detention, further clarification from Petitioner is required. No later than March 19, 2026, Petitioner shall file a memorandum addressing: (1) whether the immigration judge's removal order is administratively final; (2) whether Petitioner has filed, or intends to file, a motion with the Board of Immigration Appeals seeking acceptance of an untimely appeal; and (3) whether, in light of Respondents' supplemental response (Doc. No. 10), Petitioner contends that detention remains governed by 8 U.S.C. §§ 1225 or 1226 rather than 8 U.S.C. § 1231. No response from Respondents is required unless ordered by the Court.
