EO: On March 4, 2026, the Court received a "Verified Petition for Writ of Habeas Corpus" ("Petition"), requesting that the Court, inter alia, order Respondents to immediately release Petitioner Tuan Anh Nguyen ("Petitioner") from custody, or issue an Order to Show Cause as to why the writ should not be granted. ECF No. 1 ¶ 84. Petitioner's counsel shall be responsible for (1) promptly effecting service of the Petition, any accompanying papers, and this Entering Order on Respondents and appropriate government counsel and (2) promptly filing proof(s) of service with the Court. Specifically, the Court DIRECTS Petitioner's counsel to: (1) serve Respondents, no later than March 5, 2026, with a copy of the Petition and all accompanying papers, along with a copy of this Entering Order, by overnight mail and by e-mail to all appropriate recipients; and (2) immediately file proof(s) of such service. Counsel for Respondents shall promptly enter notices of appearance in this case. In order to help secure the just, speedy, and inexpensive determination of the Petition, the Clerk is directed to attempt a further courtesy transmission of the Petition, any accompanying papers, and this Entering Order to Respondents and appropriate government counsel using any contact information available to the Court. Such transmission is provided solely as a courtesy and shall not be deemed service of process. The Clerk is not responsible for the accuracy of contact information or for any failure or defect in service. EO: Pursuant to the request of Petitioner orally made at the status conference on March 9, 2026, and with no objection from Respondents, unless and until the Court directs otherwise, it is hereby ORDERED that Respondents shall not remove Petitioner to third country or transfer Petitioner out of this district. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966) (noting the court's express authority under the All Writs Act to issue temporary injunctions necessary for the protection of its own jurisdiction); see also D.V.D. v. U.S. Dep't of Homeland Sec., --- F. Supp. 3d ---, 2026 WL 521557, at *3, *44 (D. Mass. Feb. 25, 2026) (holding that individuals who have a final removal order issued in proceedings under Sections 240, 241(a)(5), or 238(b) of the Immigration and Nationality Act, including withholding-only proceedings, whom the Department of Homeland Security has deported or will deport on or after February 18, 2025, to a country (a) not previously designated as the country or alternative country of removal, and (b) not identified in writing in the prior proceedings as a country to which the individual would be removed have the right to meaningful notice and opportunity to object before removal to any third country). Given the exigency in this case, the Court FINDS that there is a compelling need to maintain the status quo pending disposition of the Petition, ECF No. 1, and that the factors governing the issuance of such preliminary relief have been satisfied.
