District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The record establishes that, when he initiated this action, the petitioner was in the custody of immigration officers in Massachusetts. Thus, this Court has jurisdiction over the petition. Soon after the petition was filed, the petitioner was moved to New York. The move occurred before Judge Young’s order staying any transfer of the petitioner and, therefore, did not violate that order. No further orders entered limiting the petitioner’s transfer. Now, the petitioner is detained in San Diego, which is located in the Southern District of California. Doc. No. 9-1 at 3. Any order granting the petitioner relief—whether release from custody by his immediate custodian or a bond hearing conducted by the immigration court in San Diego—will operate on officials not presently named in the petition and not located within this District. The federal statute governing transfer of venue does not permit this Court, on its own, to transfer this action to the Southern District of California, as the petition could not have been brought there at the time of filing. 28 U.S.C. 1404(a). If the parties consent, however, such transfer (which here appears to serve the interests of justice and convenience of the parties) may occur. Id. Accordingly, by Friday, October 3, 2025, the parties shall file a joint status report notifying the Court whether they consent to the transfer of this action to the United States District Court for the Southern District of California.
