Stearns: ELECTRONIC ORDER entered re 6 Response to Petition for Writ of Habeas Corpus - 2241, filed by U.S. Department of Homeland Security, David Wesling, Kristi Noem, Todd M Lyons, Pamela Bondi, Antone Moniz. Petitioner Andre Julio Pinheiro Martins is a Brazilian citizen who entered the United States in April of 2021 and was released by the Department of Homeland Security (DHS). DHS acknowledges that Pinheiro Martins was released on a Form I-220A, Order of Release on Recognizance. Over the last five years, Pinheiro Martins has consistently appeared for ICE check-ins. Pinheiro is currently detained at Plymouth Correctional Facilty. Pinheiro Martins challenges his detention and seeks immediate release.The court orders that ICE facilitate a bond hearing for him before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v.
