MINUTE ORDER Granting Petition. On March 4, 2026, the Court ordered Respondents to show cause why Petitioner should not be released because DHS had failed to provide sufficient notice or an opportunity to be heard prior to re-detaining Petitioner, as required by 8 C.F.R. § 212.5(e)(2)(1). (See ECF No. 2 .) As Petitioner notes, (see ECF No. 3 ), because Respondents have failed timely to respond, the record before the Court establishes that Respondents failed to comply with their regulations in re-detaining Petitioner. Accordingly, the Court GRANTS the Petition and ORDERS Respondents to release Petitioner from detention subject to her preexisting conditions of release.
