MINUTE ORDER Denying Petitioner's Motion 6 to Enforce Judgment. On March 10, 2026, the Court ordered Respondents to provide Petitioner with a bond hearing. Petitioner received a bond hearing and now seeks review of the immigration judge's denial of bond. While Petitioner's Motion states he is making a due process challenge, in reality, Petitioner is challenging the immigration judge's discretionary decision to deny bond based on the Petitioner's pending domestic violence criminal charges. This Court does not have jurisdiction to review this discretionary decision. See Prieto-Romero v. Clark, 534 F.3d 1053, 1058 (9th Cir. 2008) ("The alien may appeal the IJ's bond decision to the BIA, see 8 C.F.R. § 236.1(d)(3), but discretionary decisions granting or denying bond are not subject to judicial review."). Further, Petitioner has failed to exhaust his administrative remedies by appealing to the BIA. See Leonardo v. Crawford, 646 F.3d 1157, 1161 (9th Cir. 2011). Accordingly, Petitioner's Motion to Enforce Judgment is denied. (no document attached) (mxc) (Entered: 03/24/2026)
