MINUTE ORDER (Text Entry Only) On March 1, 2026, Petitioner initiated this action by filing a habeas petition pursuant to 28 U.S.C. 2241. (Doc. 1 .) No explicit motion for emergency injunctive relief was filed at that time. On March 3, 2026, the assigned magistrate judge set an accelerated schedule for the matter, ordering Respondents to respond within 21 days (i.e., on March 24, 2026). (Doc. 5 .) On March 10, 2026, Petitioner filed a request for expedited treatment of his petition, referring to a transfer from another district, a motion to dismiss, and a request for a preliminary injunction which appear to have no relation to this docket. (Doc. 7 .) Thus, that request was disregarded and the Clerk of Court is now directed to TERMINATE that motion. On March 21, 2026, Petitioner filed another request for expedited treatment, arguing that "waiting for the full response timeline may result in continued unconstitutional detention." (Doc. 8 .) Considering that Respondent's response is due tomorrow, March 24, 2026, this request unnecessarily multiplies the proceedings and is also DENIED. Petitioner has referred to the timelines set forth in 28 U.S.C. § 2243. However, this Court has discretion to set a briefing schedule for a section 2241 petition that does not strictly conform to Section 2243's deadlines. See Clutchette v. Rushen, 770 F.2d 1469, 1474-75 (9th Cir. 1985). It has done so here. The Court understands Petitioner's desire to have his petition resolved as expeditiously as possible. This Court is making every effort to adjudicate the dozens of habeas petitions it receives each week as quickly as possible. MINUTE ORDER (Text Entry Only) The Court has reviewed the petitioner's Emergency Motion for Order to Show Cause re: Contempt and for Sanctions (Doc. 15) Petitioner asserts that he is entitled to release based upon the magistrate judge's recommendation that he be released. Id. at 2. The emergency motion is utterly without basis. Despite Petitioner calling the recommendation of the magistrate judge an "order" (Id. at 2), it is not an order. As the document makes clear, it is a recommendation to the assigned District Judge. (Doc. 14) Thus, the emergency motion (Doc. 15) is DENIED. This Court is wildly overburdened with an increasingly large caseload and has no time to consider such frivolous filings as this current one.
