ORDER signed by Chief District Judge Troy L. Nunley on 3/30/2026 GRANTING 7 Motion for TRO and ORDERING respondent to IMMEDIATELY RELEASE Petitioner from custody under the same conditions prior to current detention. Respondent is DIRECTED not to impose any additional restrictions, unless such restrictions are determined to be necessary at a future pre-deprivation/custody hearing and Respondent is ENJOINED and RESTRAINED from re-arresting or re-detaining Petitioner absent compliance with con stitutional protections, including 7 days' notice and a hearing demonstrating by clear and convincing evidence that Petitioner poses a danger to the community or a flight risk. Respondent is ORDERED to SHOW CAUSE why the court should not grant Petitioner's habeas petition and enter judgment in favor of Petitioner. Petitioner's appointed counsel is DIRECTED to file within 7 days of this order a supplement or Amended Habeas Petition, and respondent has 10 days to file a response. Petitioner may then file a reply within 13 days of this order. Parties are DIRECTED to indicate in a briefing whether a hearing is requested.
