(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: By 8:00 a.m. on May 7, 2026, each party shall submit a supplemental brief addressing the following: (1) whether the phrase "pending a decision on whether the alien is to be removed" in 8 U.S.C. § 1226(a) encompasses both (a) the government's pre-initiation decision-making phase and (b) the adjudicative phase before the immigration court, or is limited to one of those phases; (2) whether 8 C.F.R. § 1236.1(b), read together with 8 U.S.C. § 1226(a), imposes a mandatory sequencing requirement that conditions arrest on the prior issuance of a notice to appear (NTA), or instead governs arrest at or after initiation of proceedings without limiting the Government's authority to arrest prior to issuance of an NTA; (3) if § 1236.1 does not impose a mandatory sequencing requirement and the government fails to promptly initiate removal proceedings following an arrest pursuant to a warrant, what authority, if any, does a district court have to order the government to initiate proceedings, release the petitioner, or provide other relief; and (4) if § 1236.1 imposes a mandatory sequencing requirement and the government violates it, whether the government may cure that violation by obtaining and executing a new arrest warrant immediately upon release.
