REPORT AND RECOMMENDATIONS: IT IS RECOMMENDED that Petitioner's request for habeas corpus be GRANTED on the basis of his procedural due process claim. Respondents, including the warden, shall (A) immediately release Petitioner from custody in accordance only with the terms and conditions of his prior Order of Recognizance, without any additional bond requirements or new conditions, and (B) notify Petitioner's counsel of the exact location and time of his release no less than two hours before his release. IT IS FURTHER RECOMMENDED that Respondents are ENJOINED AND RESTRAINED from re-detaining Petitioner unless and until he receives pre-deprivation process, as provided.
