TEXT ORDER: On or before October 20 at 12:00pm, the Respondents shall file a letter detailing (1) any and all activity that has taken place in the BIA proceedings since the immigration judge's bond determination was appealed on August 21, including whether a briefing schedule has been set or proposed; (2) what legal arguments the Respondents plan to make before the BIA in that appeal, including whether they will argue that the Petitioner is subject to mandatory detention under § 1225(b), rather than discretionary detention under § 1226(a); (3) what factual arguments Respondents plan to make before the BIA, including whether they will argue that the immigration judge improperly determined that the petitioner was not a flight risk and not dangerous to the community; and (4) the Respondents' position on whether they will seek continued detention under 8 C.F.R. §§ 1003.6(c), 1003.6(d), or other relevant authority if the BIA has not issued a decision before the automatic stay lapses pursuant to § 1003.6(c)(4).
