TEXT ORDER - Currently pending before the Court is a petition for a writ of habeas corpus and an application for a TRO. ECF Nos. 1, 2. Petitioner shall not be removed from a facility within the District of New Jersey, or from the United States, without permission from this Court. The Court has authority to stay removal under the All Writs Act. See 28 U.S.C. § 1651 (permitting courts to "issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law"); F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (recognizing "a limited judicial power to preserve the court's jurisdiction or maintain the status quo by injunction pending review of an agency's action through the prescribed statutory channels"); see also Dabone v. Karn, 763 F.2d 593, 597 n.2 (3d Cir. 1985). Additionally, Petitioner shall file within seven days an Amended Petition describing what relief, if any, he seeks beyond preventing his removal from the district. So Ordered by Judge Claire C. CHAMBERS NOTE - The Court received the following e-mail from Petitioner's counsel through the emergency email account : Good afternoon,I write to inform the Court that Petitioner, Ricardo Rickett's wife advised me that Mr. Rickett was transferred to Moshannon Valley Processing Center in Pennsylvania, late yesterday evening.This transfer appears to violate the Court's Order prohibiting Mr. Ricketts' removal from the State of New Jersey. Accordingly, I respectfully request that the Court order Respondents to promptly return Mr. Ricketts to New Jersey and to immediately comply with the Court's Order.Given the urgency of the circumstances, Petitioner respectfully requests the Court's prompt intervention.
