TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus and Emergency Motion filed by Petitioner, Edwin Alexander Castro Castro, who is detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner is a native citizen of Honduras who entered the United States without inspection in or about 2005 and has resided here for approximately twenty years. He has no criminal history, is married to a United States citizen, has two United States citizen children, an approved I-130 petition with a visa number available, and a pending affirmative asylum application. Petitioner alleges that he was arrested by ICE on February 26, 2026, in Plainfield, New Jersey, and that Respondents have detained him without issuing a Notice to Appear, initiating removal proceedings, or affording him a bond hearing. He contends that he is being improperly subjected to mandatory detention under 8 U.S.C. § 1225(b), notwithstanding the orders entered in Maldonado Bautista v. Santacruz, No. 5:25-cv-01873 (C.D. Cal.), and that he is entitled to an individualized bond hearing under 8 U.S.C. § 1226(a). He also seeks a temporary restraining order prohibiting transfer outside this District. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, no later than March 6, 2026, why the Petition should not be granted.
