District Judge Leo T. Sorokin: ELECTRONIC ORDER entered.After reviewing the Petition and the Response, the Court hereby ALLOWS the Petition as follows. Respondents shall release Petitioner by 6 PM on March 10, 2026, unless he is provided a bond hearing under 8 U.S.C. 1226(a) before that time. If a bond hearing occurs, Respondents may not at the hearing argue that Petitioner is or should be detained pursuant to 8 U.S.C. 1225, nor may Petitioner be ordered detained pursuant to section 1225, and the burdens of proof at the hearing are as resolved by the First Circuit in Hernandez-Lara. Respondents shall not retaliate against Petitioner, at a bond hearing or otherwise, for filing this Petition. Respondents shall file a status report no later than March 12, 2026, describing their compliance with this Order. The Court renders this decision in light of the record before the Court, the prior decisions of this Court, and the government’s concession that this case is similar to prior cases resolved by this Court. District Judge Leo T. Sorokin: ELECTRONIC ORDER entered: re 18 MOTION to Stay re 16 Memorandum & ORDER. On September 10, 2026, the Court awarded the petitioner’s counsel attorneys’ fees pursuant to the Equal Access to Justice Act. Doc. No. 16 . The respondents have now appealed the fee award to the First Circuit. Doc. No. 17 . They have also asked the Court to stay their payment obligation until sixty days after the Supreme Court’s resolution of a case pending this term. Doc. No. 18 . That request is DENIED. The Court finds that the criteria for a stay pending resolution of either the appeal to the First Circuit in this case or the appeal to the Supreme Court in a different case are not satisfied here, including because the respondents are not likely to succeed for reasons set forth in the Court’s fee order and have not shown irreparable harm flowing from the modest monetary payment that order requires. However, an administrative stay is warranted to the following extent: The Court STAYS its Order as reflected in Doc. No. 16 pending a decision by the United States Court of Appeals for the First Circuit on a motion to stay pending appeal, provided the respondents file such a motion in the Circuit no later than October 6, 2026. If no motion is filed in the Circuit by that date, the administrative stay will automatically terminate on October 7, 2026. If a motion is timely filed, the administrative stay will remain in place until the Circuit rules on the motion.(FGD) (Entered: 09/29/2026)
