Respondents are ENJOINED from moving petitioner outside of Minnesota until further order of the Court, so that petitioner may consult with counsel while the Court is considering the petition, and so that there is no risk that removal of petitioner from Minnesota will deprive this Court of jurisdiction over the petition. ORDER adopting in part 8 Report and Recommendation. 1 Petitioner's petition for a writ of habeas corpus is GRANTED as set forth herein. Respondents are required to immediately release petitioner in Minnesota without subjecting him to conditions greater than those specifically imposed in his July 28, 2005, Order of Supervision. Respondents are required to release petitioner with all his personal effects seized during his arrest, as well as, all identification documents and immigration documentation. Respondents are precluded from redetaining petitioner under a statutory theory this Court has rejected in this proceeding absent materially changed circumstances. See Order for details.
