TEXT ORDER granting 2 Motion for Temporary Restraining Order; 3 Motion to Expedite. On February 27, 2026, the Court conducted a telephone conference with the parties in this matter. Respondents confirmed that Petitioner is being detained pursuant to 8 U.S.C. § 1226(a) and acknowledged that she is entitled to a bond hearing pursuant to that statute. But despite Petitioner's request for one on February 23, 2026, no bond hearing has been provided to her and she has remained in custody of the Allegany County Jail. For the reasons discussed at the telephone conference, the Court grants Petitioner's motion for temporary restraining order and motion to expedite to the extent that Respondents are ordered to IMMEDIATELY release her from custody pursuant to the same terms and conditions as her prior release with no additional constraints on release, including but not limited to no ankle monitor, GPS monitor, or any other alternatives to detention. Petitioner's property seized at the time of detention shall be returned to her at the time of her release. The Court further directs counsel to meet and confer on or before March 4, 2026, to reach an agreement on a briefing schedule for any remaining matters in the petition and to advise the Court by that date. If the parties cannot agree, they may submit competing proposals on or before the same date. The submissions should be made by letter and shall be filed on the docket. Absent submission(s) in accordance with this Text Order, the Court will sua sponte set the briefing schedule. SO ORDERED. Signed by Hon. Elizabeth A. Wolford on 02/27/2026.
